These Terms and Conditions ("Terms") govern the registration, activation, and use of the Mea Culpa Fidelity Program ("the Program") provided by BEERMANIA SPRL ("Beermania," "we," "us," or "our"). By registering for the Program, you ("the Subscriber") agree to be bound by the following rules.
1. Program Overview
The Mea Culpa Fidelity Program is an annual subscription service. For a flat fee of €100 per year, an active Subscriber is entitled to redeem exactly one (1) Mea Culpa beer per calendar day at our physical location, subject to Beermania’s standard operating hours and product availability.
2. Registration and In-Person Activation
Application: Registration must be initiated via the Beermania web application. During registration, the Subscriber must upload a clear, current, and recognizable photograph of their face.
In-Person Payment: Online registration does not activate the subscription. To activate the Program, the Subscriber must physically visit Beermania and pay the €100 annual fee at the bar.
Validity Period: The subscription is valid for exactly 365 days starting from the date the in-person payment is processed and the account is activated by staff.
Refund Policy: The €100 subscription fee is strictly non-refundable under any circumstances, including failure to utilize the daily allowance, relocation, or termination of the account due to rule violations.
3. Strict Non-Transferability and Identity Verification
The core principle of this Program is that it is entirely personal to the registered Subscriber.
No Sharing: The subscription, the daily allowance, and the web application QR code are strictly non-transferable. You may not share your account, phone, or QR code with friends, family members, or other patrons.
Visual Verification: To redeem the daily beer, the Subscriber must present their personal QR code via their smartphone to Beermania staff. Upon scanning, the staff will be shown the Subscriber's profile photo.
Right to Request ID: Staff reserve the right to request a physical government-issued ID if the profile photo does not clearly match the person presenting the QR code.
Zero-Tolerance Fraud Policy: If Beermania staff determine that a QR code is being presented by anyone other than the registered Subscriber, the subscription will be immediately and permanently revoked without warning and without refund.
4. Redemption Rules
Daily Limit: The allowance is strictly capped at one (1) Mea Culpa beer per calendar day.
No Rollovers: Unclaimed beers do not roll over to the next day, week, or month. If you do not visit Beermania on a given day, that day's beer is forfeited.
On-Premise Only: The redeemed beer is intended for on-premise consumption unless explicitly authorized by staff for takeaway (subject to standard packaging rules).
System Outages: In the rare event of a technical failure with the scanning application, Beermania staff maintain a manual log, and their discretion on redemption eligibility is final.
5. Responsible Service and Right of Refusal
Responsible Drinking: Beermania strictly adheres to Belgian laws regarding the responsible service of alcohol.
Right of Refusal: Beermania staff reserve the right to refuse the daily Mea Culpa redemption to any Subscriber who appears visibly intoxicated, acts aggressively, or violates standard house rules. Refusal of service for behavioral reasons does not entitle the Subscriber to a refund or an alternative redemption.
Age Restriction: Subscribers must be of legal drinking age in Belgium.
6. Data Privacy (GDPR)
To operate the Program, Beermania collects personal data including your name, email, profile photograph, and a log of your daily redemptions. This data is used exclusively to facilitate the Program, verify identity to prevent fraud, and manage your subscription. Your data will never be sold to third parties. By uploading your photo and using the app, you consent to our staff viewing this photo daily for verification purposes.
7. Program Modifications
Beermania reserves the right to modify these Terms, the subscription price for future renewals, or the specific beer offered (in the event of extreme supply shortages) with prior notice.
By paying the activation fee at the bar, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
